When mechanics and materialmen come to us for assistance, we make sure they are qualified to file a lien. A mechanic must have a proper license from the state for that line of work. The materialman does not need a license, but if a corporation, must be in good standing. Once you file your lien you have six months to foreclose on your lien or the lien becomes void.
When it is time to foreclose on the lien, we obtain a title report which lists all who have liens against the property. The original purchase and construction loans of the owner take priority over the materialman's and mechanic's liens. The materialman's and mechanic's liens all have equal priority regardless of the time filed. We examine the report to determine whether a foreclosure would be worthwhile for our client. If so, we bring the action notifying all lien holders so the court may resolve the rights of all at the same time. At the hearing, the court determines lien holder priority and orders the sale. We monitor the sale to see that our client's lien is paid according to the court order.
