Advertising Rules

Here are some of the rules a broker must adhere to in real estate listings and promotion:

• Disclosure of Agent Involvement: You must disclose that an agent is involved in a sale when making a listing. If the agent is also the owner, the listing must say "owner/agent." All listings must have the registered name of the listing broker.
• No Misrepresentation: If you mention improvements that are still being built, you must say that. If your picture of a real estate site is an artist rendering, you must disclose this in a caption. If your promotional photograph is taken from a distance including more property than is actually being sold, you must state the distance of the property from the point the picture was taken from.
• Developer Disclosures: You can promote an uncompleted development but must state a realistic completion date. You may not suggest in the advertising that buyers have exclusive use of a nearby golf course or country club if those services are open to the public. Furthermore if the country club is private and has the right to deny membership to the buyer, that must be stated.
